A Milwaukee woman has been jailed for 11 years for killing the man that prosecutors said had sex trafficked her as a teenager.
The sentence, issued on Monday, ends a six-year legal battle for Chrystul Kizer, now 24, who had argued she should be immune from prosecution.
Kizer was charged with reckless homicide for shooting Randall Volar, 34, in 2018 when she was 17. She accepted a plea deal earlier this year to avoid a life sentence.
Volar had been filming his sexual abuse of Kizer for more than a year before he was killed.
Kizer said she met Volar when she was 16, and that the man sexually assaulted her while giving her cash and gifts. She said he also made money by selling her to other men for sex.
An investigation by the Washington Post found that authorities had evidence, including video, that Volar was abusing about a dozen girls including Kizer - all of whom appeared to be underage. Four months before Volar died, police arrested him on charges of sexual assault but released him the same day. Police said that Kizer travelled from Milwaukee to Volar's home in Kenosha in June 2018 armed with a gun. She shot him twice in the head, set his house on fire and took his car.
Prosecutors said the killing was pre-meditated, and part of a scheme to steal Kizer's car. Lawyers for Kizer argued that she acted in self-defence.
Kizer's case had tested the leniency granted to victims of sex trafficking. Some states have implemented laws - called "affirmative defence" provisions - that protect victims from some charges including prostitution or theft, if those actions were the result of being trafficked. Kizer had tested whether an "affirmative defence" for trafficking victims could be used for homicide. In 2022, the Wisconsin Supreme Court ruled she could.
The ruling allowed Kizer to use evidence to demonstrate her abuse at the time of the crime. The case attracted widespread attention and Kizer received support from activists in the #MeToo movement.
She ultimately chose a plea deal to avoid risking a possible life sentence at trial.
"I get to try to move on," Kizer told the Washington Post in an interview from jail this year.
She has already served more than a year and half of her sentence. She will face five years of extended supervision after her eventual release.
Chrystul Kizer is jailed and she shouldn't be. She defended herself from a monster, a proven sex trafficker who not only raped her himself but received pay from other men to repeatedly do the same. The police arrested Volar...a White man who was sex trafficking multiple girls, all minors!...four months before Kizer shot him in self defense, but these same police released him the same day.
"...An investigation by the Washington Post found that authorities had evidence, including video, that Volar was abusing about a dozen girls including Kizer - all of whom appeared to be underage..."
Kizer saved herself, at least a dozen other girls, and untold scores of girls from the unabated predations of Volar and the evil men who he did business with as they sexually exploited and trafficked these girls, had Kizer not stopped him and his evil.
Kizer is a hero, who deserves to be free along with all the other girls she saved. All of these girls deserve to tell their stories and be held up as the victims, survivors and inspirations to destroy sex trafficking worldwide that they truly are. Instead, the conservative, cruel, abominable, repulsive racistfeudalist system imprisoned Kizer, sending the message that even the "justice system" will punish the victims of sex trafficking, with the result being? More and more girls will succumb to and suffer from sex trafficking because they know for a fact that even if they fight back, they will be punished from all sides: the illegal underground traffickers and the so-called justice system. Because neither care for them, and both want them to be victimized. Chrystul Kizer’s imprisonment sends a chilling message that echoes through the corridors of injustice: the system is designed not to protect the vulnerable but to further victimize them. By incarcerating a young Black woman who bravely defended herself from a known predator, the justice system reinforces the horrifying reality that survivors of sex trafficking are disposable, their lives deemed less valuable than those of their abusers. This case underscores the deep-seated racism and misogyny that permeates the legal system, where the rights of marginalized individuals are routinely trampled. Kizer's imprisonment is not just an individual injustice—it is a stark reminder of the systemic failures that perpetuate the cycle of abuse, silencing those who dare to resist and leaving countless others in the clutches of their tormentors.
Let me put it to you this way: If a pretty White teenager had video evidence of herself being sexually abused by a Black man...video the Black man took on his own for his own amusement...for more than a year. And this same Black man abused more than a dozen White girls, as well as sold these White girls to other Black men to likewise sexually abuse. Do you think that she would be in jail? Do you think that one single Black man would escape the death penalty or life imprisonment?
Exactly.
And that is just one of dozens of reasons why Chrystul Kizer must be liberated from prison!
